Terms & Conditions of Service

The standing terms that apply to garage door installation and repair work performed by Chase Garage Doors, Inc. in Riverside County and the Inland Empire. CSLB License #901736.

Scope & definitions

  • "Chase," "we," "us" means Chase Garage Doors, Inc., a California corporation, CSLB License #901736.
  • "You," "Customer" means the person or entity who signed the contract for the work.
  • "The work" means the labor, materials, and equipment described in the signed contract, and nothing else.
  • "The contract" means the signed written agreement, plus any change order signed by both parties.
  • "Change order" means a written document, signed by both parties before the extra work begins, that states the scope of the change, the amount added to or subtracted from the contract price, and the effect on the completion date.

These terms apply to residential garage door installation, replacement, and repair. Work on an existing residence is a home improvement contract under California Business and Professions Code §7159.

What is not included

Unless the contract says so in writing, the work does not include: permits or permit fees; electrical work beyond connecting an opener to an existing dedicated outlet; framing, header, jamb, drywall, stucco, or concrete repair; painting; structural modification of the opening; or removal of anything other than the door and hardware being replaced.

Estimates & pricing

A written estimate is an offer to perform the described work at the stated price. It may be withdrawn if not accepted within 30 days.

Estimates are based on what could be seen and measured at the time. If conditions inside the opening, in the framing, or in existing hardware turn out to be different from what was visible, we will stop, tell you what we found, and give you the cost in writing. We will not proceed with the additional work, and you will not owe anything for it, until you sign a change order.

Prices for doors, openers, springs, and hardware reflect manufacturer pricing at the time of the estimate.

If a manufacturer changes pricing or a model becomes unavailable before your order is placed, we will contact you with the options and the price difference in writing before ordering.

Extra work and change orders

California required notice — Bus. & Prof. Code §7159(d)(13)Extra Work and Change Orders become part of the contract once the order is prepared in writing and signed by the parties prior to the commencement of work covered by the new change order. The order must describe the scope of the extra work or change, the cost to be added or subtracted from the contract, and the effect the order will have on the schedule of progress payments.

No employee, technician, or salesperson can authorize extra work verbally. If it is not on a signed change order, it is not authorized and it is not payable.

Payment terms

Downpayment: California required notice — Bus. & Prof. Code §7159(d)(8)THE DOWNPAYMENT MAY NOT EXCEED $1,000 OR 10 PERCENT OF THE CONTRACT PRICE, WHICHEVER IS LESS.

This is the lesser of the two amounts, not whichever is larger. On any job above $10,000 the cap is always $1,000. There is no exception for special-order materials.

Balance

The balance is due on completion of the installation. We do not collect payment for work that has not been performed or for materials that have not been delivered.

If you cancel

If you cancel within your cancellation period (see section "Three-day right to cancel"), you get everything you paid back within 10 days, including the downpayment. If you cancel after that period, we will refund your payment less the value of work actually performed and materials actually ordered for your job, and we will itemize that amount for you in writing.

Late payment

Balances not paid when due accrue a late charge of 1% per month on the unpaid amount until paid.

Returned checks

A returned check carries a $50.00 fee, plus any processing fee and applicable taxes.

Lien release on payment

California required notice — Bus. & Prof. Code §7159(c)(4)Upon satisfactory payment being made for any portion of the work performed, the contractor, prior to any further payment being made, shall furnish to the person contracting for the home improvement or swimming pool work a full and unconditional release from any potential lien claimant claim or mechanics lien authorized pursuant to Sections 8400 and 8404 of the Civil Code for that portion of the work for which payment has been made.

Limited warranty

Chase Garage Doors, Inc. warrants its workmanship for one (1) year from the installation date shown on your contract. If our installation work is defective, we will correct it at no charge to you.
‍
Parts and materials — doors, openers, springs, cables, rollers, remotes, keypads, and other components — are covered solely by the manufacturer's warranty, which passes through to you. We will help you make a manufacturer claim and will install warranty replacement parts, though manufacturer warranties vary by brand and model and some cover parts only, not labor.

This is a limited warranty, not a full warranty, as those terms are used in the federal Magnuson-Moss Warranty Act. You may ask to read it before you buy, and a copy is always available here.

Additional warranty terms on your contract

If a technician agreed to something beyond this warranty, it is only binding if it is written in the Additional Warranty Terms box on your signed contract and initialed by both of you. Terms written in that box add to this warranty. They never reduce it. If that box is blank or marked "None," this printed warranty is the entire warranty for your job.

What the warranty excludes

This limited warranty does not cover:

  • A door coming off track, or a cable coming off the drum, caused by opening the door beyond its designed travel.
  • Broken or damaged glass and windows after installation.
  • Sensor misalignment occurring after installation. Safety sensors are mounted within six inches of the floor and are commonly knocked out of alignment by vehicles, bikes, trash cans, and pressure washing.
  • Damage from impact, vehicle contact, storms, wind, flooding, earthquake, power surges, pests, rodents, or settling of the structure.
  • Water intrusion. Weatherstripping and molding reduce wind and dust. They are not a water seal. A garage door is not a watertight assembly and no garage door we install is warranted against water entering the garage.
  • Normal wear: spring fatigue over cycles, roller and bearing wear, finish weathering, and hardware loosening from ordinary use.
  • Rust or corrosion, including corrosion accelerated by coastal air, sprinklers, or chemicals stored in the garage.
  • Any repair or service performed on pre-existing doors, openers, springs, or hardware not supplied by Chase Garage Doors, Inc.
  • Work performed on the door, opener, or hardware by anyone other than Chase after our installation.
  • Damage caused by failure to perform routine maintenance, or by continuing to operate a door that is visibly damaged, binding, or making abnormal noise.
  • Cosmetic variation in color, grain, or texture between panels, or between a replacement panel and panels installed earlier. Steel and paint lots vary.

If the door or opener is used in a commercial or multi-family setting, or at a cycle count beyond residential use, manufacturer warranties frequently do not apply. Tell us before we order if that is your situation.

Making a warranty claim

Call or text 951.329.8799, or email us. Have your PO/Invoice number from your contract ready.

We will schedule warranty service within seven (7) business days of your request. Completing the repair may take longer when parts must be ordered from a manufacturer, when a manufacturer must authorize the claim, or when the property is not accessible. We will tell you what we are waiting on.

Warranty service requires reasonable access to the door and the opener during normal business hours, and a garage that is clear enough to work in safely.

  • Deadline to file a complaintSeparately from this warranty, you may file a complaint with the Contractors State License Board. CSLB generally has authority to investigate a complaint against a licensed contractor filed within four years. See section 17 for how to reach CSLB.

Limitation of liability

Except for the claims listed under "What this section does not limit" below, and to the fullest extent permitted by California law:

  • Our total liability for any claim arising out of or relating to the work will not exceed the amount you actually paid Chase Garage Doors, Inc. for the specific job that gave rise to the claim.
  • We are not liable for indirect, incidental, special, or consequential damages, including lost profits, loss of use of the garage or a vehicle, vehicle storage or rental costs, lost wages, or damages for delay.
  • We are not liable for damage to items stored in the garage or in the path of the door that you were asked to move and did not move. See section 11.
What this section does not limit

Nothing in these terms limits, excludes, or caps our liability for any of the following, and any attempt to read it that way should be disregarded:

  • Death or bodily injury caused by our negligence.
  • Fraud or intentional misrepresentation.
  • Willful injury to the person or property of another.
  • Gross negligence or willful misconduct.
  • Any violation of law, whether willful or negligent.
  • Any liability that cannot be limited or disclaimed under California law, including the Song-Beverly Consumer Warranty Act and the contractor licensing laws.

Your statutory rights are not affected. Nothing in these terms waives or limits your rights under Business and Professions Code §7159, your right to cancel under section 14, your right to require a performance and payment bond, or your right to file a complaint with the Contractors State License Board. A consumer cannot waive those rights by contract, and we are not asking you to.

Entire agreement — no verbal promises

Your signed written contract, together with any change order signed by both parties and these terms as they existed on your contract date, is the entire agreement between you and Chase Garage Doors, Inc.

‍No verbal statement, promise, estimate, or representation made by any employee, technician, salesperson, or agent is binding on Chase Garage Doors, Inc. unless it is written on the contract and signed by both parties.

This protects both of us. It means you are not relying on something a technician said in your driveway and cannot later prove, and it means we cannot be held to a promise nobody wrote down. If something matters to you, ask for it in writing before you sign. We will write it in. The Additional Warranty Terms box on the contract exists for exactly that purpose.

This section does not limit liability for fraud or intentional misrepresentation. See section 8.

Indemnification

California definition — Civil Code §2772Indemnity is a contract by which one engages to save another from a legal consequence of the conduct of one of the parties, or of some other person.
What you cover

You agree to indemnify, defend, and hold harmless Chase Garage Doors, Inc. from claims, damages, and reasonable costs that arise out of:

  • Your breach of the contract or of these terms.
  • A misrepresentation you made about the property, including about ownership or your authority to authorize the work.
  • Your failure to disclose a known hazard or concealed condition at the property.
  • Work you directed us to perform against our written recommendation, to the extent the claim arises from that direction.
  • Acts or omissions of you, your household, your tenants, or other contractors you hired.
  • Where you signed as a tenant, your failure to obtain the property owner's authorization.
What we cover

Chase Garage Doors, Inc. agrees to indemnify, defend, and hold you harmless from claims, damages, and reasonable costs that arise out of:

  • Bodily injury or property damage caused by our negligent or willful acts or omissions, or those of our employees and subcontractors.
  • Any mechanics lien recorded against your property by our subcontractors or suppliers for amounts you already paid us.
  • Our violation of applicable law in performing the work.
Limits that apply both ways

Neither party indemnifies the other for the other party's own negligence, gross negligence, or willful misconduct. Neither party is obligated to indemnify the other where Civil Code §1668 or other California law prohibits it. A party seeking indemnity must give the other prompt written notice of the claim and a reasonable opportunity to participate in its defense.

Customer responsibilities

Before we arrive

The garage must be clear left to right and 10 feet back from the door for the garage door to be installed.
We cannot move your belongings, and we will not be responsible for damage to items left in the work area after you were asked to clear it.

You also agree to:

  • Move vehicles out of the garage and out of the driveway path before the crew arrives.
  • Provide safe access to the garage, to the opener, and to a working power outlet.
  • Secure pets and keep children away from the work area for the duration of the job.
  • Tell us about known hazards: asbestos, lead paint, mold, damaged framing, faulty wiring, structural damage, or anything else we would not see.
  • Tell us before work begins if you are a tenant rather than the owner, and provide the owner's written authorization.
  • Disclose any HOA requirement, architectural approval, or recorded restriction affecting door style or color. Obtaining HOA approval is your responsibility unless the contract says we are handling it.
  • Be present, or have an adult present, at completion so we can demonstrate the door's operation and safety reverse.

After installation
‍
Test the safety reverse monthly, per the manufacturer's instructions. Keep sensors clear and aligned. Do not let children operate or play near the door or its remotes. Never attempt to adjust or remove a torsion spring, cable, or drum — these are under extreme tension and can cause serious injury or death. Call us instead.

Replaced parts

Doors, openers, springs, cables, drums, rollers, tracks, and other components removed during the work become the property of Chase Garage Doors, Inc. and are recycled or disposed of, unless you ask us in writing to leave them with you before the work begins.

If you ask for removed parts back, understand that springs, cables, and drums may still hold tension or may be damaged, and that handling them is dangerous. We will leave them on the property; we will not reinstall them, and we do not warrant them in any way.

Haul-away and disposal of the old door is included only when the contract says so.

Three-day right to cancel

Read this on your signed contract, not here. The law requires us to give you this notice in the contract itself, in at least 12-point boldface type, next to a line for your signature, along with two detachable copies of the Notice of Cancellation. Your cancellation period runs from the day you received a signed and dated copy of that contract. Nothing on this web page starts, extends, or shortens that period.

Three-Day Right to Cancel

‍
You, the buyer, have the right to cancel this contract within three business days. You may cancel by emailing, mailing, faxing, or delivering a written notice to the contractor at the contractor's place of business by midnight of the third business day after you received a signed and dated copy of the contract that includes this notice. Include your name, your address, and the date you received the signed copy of the contract and this notice.

If you cancel, the contractor must return to you anything you paid within 10 days of receiving the notice of cancellation. For your part, you must make available to the contractor at your residence, in substantially as good condition as you received them, goods delivered to you under this contract or sale. Or, you may, if you wish, comply with the contractor's instructions on how to return the goods at the contractor's expense and risk. If you do make the goods available to the contractor and the contractor does not pick them up within 20 days of the date of your notice of cancellation, you may keep them without any further obligation. If you fail to make the goods available to the contractor, or if you agree to return the goods to the contractor and fail to do so, then you remain liable for performance of all obligations under the contract.

If you are 65 or older

‍
If you are a senior citizen, you have five business days to cancel, not three. Your contract will say "Five-Day Right to Cancel" and every reference to the third business day will read fifth business day instead. If you are 65 or older and your contract shows the three-day version, tell us and we will reissue it.
Counting business days

Business days do not include Saturdays, Sundays, or holidays. A contract signed on a Wednesday is cancellable through midnight the following Monday.

Notice of cancellation

To cancel this transaction, email, call, or deliver a signed and dated copy of this cancellation notice, or any other written notice, to Chase Garage Doors, Inc., at the address above, not later than schedule date.

Mechanics lien warning

Two completed copies of this form are attached to your signed contract, printed on a detachable section. If you have lost them, you may still cancel in writing by any method described in section 14 — the form is a convenience, not a requirement. The text below is the form's wording.

MECHANICS LIEN WARNING:
Anyone who helps improve your property, but who is not paid, may record what is called a mechanics lien on your property. A mechanics lien is a claim, like a mortgage or home equity loan, made against your property and recorded with the county recorder.

Even if you pay your contractor in full, unpaid subcontractors, suppliers, and laborers who helped to improve your property may record mechanics liens and sue you in court to foreclose the lien. If a court finds the lien is valid, you could be forced to pay twice or have a court officer sell your home to pay the lien. Liens can also affect your credit.

To preserve their right to record a lien, each subcontractor and material supplier must provide you with a document called a 'Preliminary Notice.' This notice is not a lien. The purpose of the notice is to let you know that the person who sends you the notice has the right to record a lien on your property if they are not paid.

BE CAREFUL. The Preliminary Notice can be sent up to 20 days after the subcontractor starts work or the supplier provides material. This can be a big problem if you pay your contractor before you have received the Preliminary Notices. You will not get Preliminary Notices from your prime contractor or from laborers who work on your project. The law assumes that you already know they are improving your property.

PROTECT YOURSELF FROM LIENS. You can protect yourself from liens by getting a list from your contractor of all the subcontractors and material suppliers that work on your project. Find out from your contractor when these subcontractors started work and when these suppliers delivered goods or materials. Then wait 20 days, paying attention to the Preliminary Notices you receive.

PAY WITH JOINT CHECKS. One way to protect yourself is to pay with a joint check. When your contractor tells you it is time to pay for the work of a subcontractor or supplier who has provided you with a Preliminary Notice, write a joint check payable to both the contractor and the subcontractor or material supplier.

For other ways to prevent liens, visit CSLB's internet website at www.cslb.ca.gov or call CSLB at 800-321-CSLB (2752).

REMEMBER, IF YOU DO NOTHING, YOU RISK HAVING A LIEN PLACED ON YOUR HOME. This can mean that you may have to pay twice, or face the forced sale of your home to pay what you owe.

CSLB notice

Two completed copies of this form are attached to your signed contract, printed on a detachable section. If you have lost them, you may still cancel in writing by any method described in section "Three-day right to cancel"— the form is a convenience, not a requirement. The text below is the form's wording.

Information about the Contractors State License Board (CSLB): CSLB is the state consumer protection agency that licenses and regulates construction contractors.Contact CSLB for information about the licensed contractor you are considering, including information about disclosable complaints, disciplinary actions, and civil judgments that are reported to CSLB.

If you use an unlicensed contractor, CSLB may not be able to help you resolve your complaint. Your only remedy may be in civil court, and you may be liable for damages arising out of any injuries to the unlicensed contractor or the unlicensed contractor's employees.

The job includes material and labor as required in accordance with the specifications written on your contract. This offer may be withdrawn if not accepted within 30 days.

Your signature gives Chase Garage Doors, Inc. the right to complete the described work for the stated price. All terms are C.O.D. upon completion of installation.

All material and labor is guaranteed one (1) full year from the date of invoice unless otherwise stated on the contract, with the exception of repairs and service provided on existing automatic openers. Disputes & attorney fees

Talk to us first

Most problems get solved with a phone call. Call or text 951.329.8799 or email us and describe the issue. We would rather fix it than argue about it.

Your other options

You are free to file a complaint with the Contractors State License Board at any time, regardless of anything in these terms. CSLB complaints are free. Small claims court is also available for smaller disputes and does not require a lawyer.

Attorney fees

In any action to enforce the contract, the prevailing party is entitled to recover reasonable attorney fees and costs. This runs both ways. Under California Civil Code §1717, an attorney fee provision in a contract is reciprocal by operation of law, so a one-sided clause would not be enforceable as written in any event.

Venue

Any action arising out of the contract or these terms is to be brought in the state courts located in Riverside County, California.

Governing law & acknowledgement

These terms and your contract are governed by the laws of the State of California, without regard to conflict-of-laws rules.

Severability

If any provision of these terms is held unenforceable, that provision is modified to the minimum extent necessary to make it enforceable, or severed if it cannot be. The rest remains in effect. In particular, if any part of section 8 or section 10 is held unenforceable, the remainder of those sections still applies.

No waiver of your statutory rights

Nothing on this page waives, limits, or shortens any right California law gives you as a consumer, including your right to cancel, the notices required by Business and Professions Code §7159, your rights under the Song-Beverly Consumer Warranty Act, or your right to complain to the Contractors State License Board. Where any term on this page conflicts with California law, the law controls and that term does not apply.

Acknowledgement

By signing the contract, you acknowledge that you received a completely filled in copy of the agreement signed by both you and the contractor before work began; that you received the required notices, including the right to cancel and the mechanics lien warning, in that contract; that you have had the opportunity to read these terms and ask questions; and that you are not relying on any verbal promise that does not appear in writing in the signed contract.
